Assumption of Risk
I acknowledge that this activity involves known and unanticipated risks, including but not limited to muscle strains, falls, dropped weights, equipment malfunction, cardiovascular incidents, and contact with other members. I understand that such risks cannot be eliminated without jeopardizing the essential qualities of the activity, and I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation is purely voluntary, and I elect to participate in spite of the risks.
Physical Condition
I certify that I have no medical condition that would prevent safe participation in physical exercise, and I acknowledge that the business recommends consulting a physician before beginning any exercise program.
Facility Rules
I agree to use equipment only as intended, to re-rack weights, to ask staff for instruction on unfamiliar equipment, and to follow all posted facility rules.
Release and Waiver of Liability
In consideration of being permitted to participate in use of the fitness facility, its equipment, and its classes, I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby release, indemnify, and hold harmless the business, its officers, employees, and agents (the "Released Parties") from any and all claims, demands, losses, and liability arising out of or related to any injury, disability, death, or loss or damage to person or property, whether arising from the negligence of the Released Parties or otherwise, to the fullest extent permitted by law.
Medical Authorization
I certify that I am physically fit and have no medical condition that would prevent my safe participation. I authorize the business to secure emergency medical treatment on my behalf if needed, and I agree to be financially responsible for any such treatment.
Severability and Governing Law
I agree that this agreement is intended to be as broad and inclusive as permitted by the laws of the state in which the activity takes place, and that if any portion is held invalid, the remainder shall continue in full legal force and effect.
