Terms of Service

1. The service

NeatWaiver lets businesses create digital liability waivers, collect electronic signatures from their customers, and store the resulting signed documents. By creating an account or signing a waiver through NeatWaiver, you agree to these terms. If you use NeatWaiver on behalf of a business, you represent that you are authorized to bind that business.

2. Not legal advice

NeatWaiver is not a law firm and does not provide legal advice. Our waiver templates are generic starting points, not documents tailored to your business or state. Whether a waiver is enforceable depends on your jurisdiction and circumstances — have your waiver reviewed by an attorney licensed in your state. You are solely responsible for the content of the waivers you publish.

3. Accounts

  • You must provide accurate information and keep your credentials secure; you are responsible for activity under your account.
  • You must be at least 18 years old to create a business account.
  • We may suspend or terminate accounts that violate these terms or put the service or other users at risk.

4. Plans and billing

  • The Free plan is limited to 1 active waiver and 20 signatures per month. Paid plans (Basic and Pro) are billed monthly or yearly through Stripe.
  • Subscriptions renew automatically until you cancel. When you cancel, your plan stays active until the end of the paid period, then downgrades to Free.
  • Fees are non-refundable except where required by law. We will give notice before any price change takes effect on your plan.
  • If a downgrade puts you over the Free plan's limits, existing signatures remain stored and accessible, but new activity is limited to what the plan allows.

5. Signatures and your data

  • Signed waivers are immutable by design: once a customer signs, the signature, the exact waiver text, and the audit trail cannot be edited or deleted, and remain stored even if the waiver is archived. This protects both you and your signers.
  • As between you and NeatWaiver, you own your waiver content and your signers' data. You grant us the license needed to host, process, and display it in order to run the service.
  • You are responsible for having a lawful basis to collect signer information, including information about minors signed for by a parent or guardian.

6. Acceptable use

You agree not to:

  • Use NeatWaiver for anything unlawful, deceptive, or fraudulent, or to collect signatures for documents that are not genuine agreements.
  • Attempt to access other businesses' data, probe or disrupt the service, or circumvent plan limits.
  • Upload malicious content or use the service to send spam.

7. Electronic signatures

NeatWaiver implements the consent and record-keeping practices of the U.S. ESIGN Act, including explicit signer consent, immutable document versions, and an audit trail. We cannot guarantee that any particular signed waiver will be enforceable in a given dispute — enforceability depends on the waiver's content and applicable law.

8. Disclaimers and liability

The service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, NeatWaiver will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or business interruption. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

9. Termination

You can stop using NeatWaiver at any time and request account closure. We may retain signed waivers and their audit trails after closure where retention is legally required or prudent given their evidentiary purpose, as described in our Privacy Policy.

10. Changes and contact

We may update these terms; for material changes we will update the date above and notify business owners by email before the changes take effect. Continued use after that means you accept the new terms. Questions? Contact us at legal@neatwaiver.com.
